Welcome to Modern Elevation! Modern Elevation is a brand operated by Modern Brand Holdings LLC. The terms "we," "us," and "our" refer to Modern Brand Holdings LLC, doing business as Modern Elevation. We operate the website www.modernelevation.com, including all related information, content, features, tools, products, and services in order to provide you, the customer, with a curated shopping experience (the "Services"). Modern Elevation is powered by Shopify, which enables us to provide the Services to you.

The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services. Please read these Terms carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms or our Privacy Policy, you should not use or access our Services.

Section 1 – Access and Account

You represent that you are at least the age of majority in your state or province of residence and that you have given us your consent to allow any of your minor dependents to use the Services. We do not guarantee that products or services purchased will meet your expectations or match online depictions. Product descriptions and availability may change without notice. We reserve the right to limit quantities sold to any person or region.

Section 3 – Orders

Placing an order is an offer to purchase. We reserve the right to accept or decline any order at our discretion. We must receive and process your payment before accepting your order. You may cancel an order at any time before it is fulfilled by contacting us at support@modernelevation.com. Purchases are subject to our Return & Refund Policy. You warrant that purchases are for personal or household use and not for commercial resale or export.

Section 4 – Prices and Billing

Prices, discounts, and promotions are subject to change without notice. Posted prices do not include taxes, shipping, handling, customs, duties, tariffs, or import charges. You agree to provide current, complete, and accurate payment and account information for all purchases. You warrant that you are authorized to use any payment method you provide and that you will pay all charges incurred at posted prices plus applicable taxes and fees.

Section 5 – Shipping and Delivery

Our Shipping Policy is incorporated by reference. Key terms include: Orders typically process within 1 to 3 business days. Estimated delivery times are 9 to 12 business days for Economy and 5 to 9 business days for Priority (see full Shipping Policy for details). We ship within the United States only. We do not ship to PO Boxes, US territories, or APO and FPO addresses. Some orders may be subject to import duties, tariffs, customs taxes, or fees. Where these apply, they are the responsibility of the customer and are not included in the product price or shipping cost. Risk of loss passes to you once we transfer products to the carrier.

Our Return & Refund Policy is incorporated by reference. The Return & Refund Policy in effect at the time of your purchase governs that order.

Modern Elevation is a trademark of Modern Brand Holdings LLC. All trademarks, brands, text, images, product photography, and other content on our Services are owned by Modern Brand Holdings LLC or its licensors and protected by law. You may use the Services for personal, non-commercial purposes only. You may not reproduce, distribute, or exploit our content without written permission.

Section 8 – Third-Party Links and Tools

The Services may include links to or tools from third parties. We do not monitor or control such third parties and provide access "as is" and "as available." Use them at your own risk.

Section 9 – Relationship with Shopify

Modern Elevation is powered by Shopify, which enables us to provide the Services. However, any sales and purchases are made directly with Modern Brand Holdings LLC. By using the Services, you acknowledge that Shopify is not responsible for any sales, products, or services between you and Modern Brand Holdings LLC.

Section 10 – Privacy

All personal information collected through the Services is subject to our Privacy Policy, which can be found on our website. Some information may also be subject to Shopify's Privacy Policy. By using the Services, you consent to these practices.

Section 11 – Feedback

By submitting Feedback (reviews, suggestions, etc.), you grant us a worldwide, royalty-free license to use and display such Feedback. You represent and warrant that you own or have the necessary rights to your Feedback and that it complies with applicable laws. Nothing in these Terms restricts your ability to post an honest review of our products or services.

We reserve the right to correct any typographical errors, inaccuracies, or omissions and to change or update information without notice, including after you submit an order.

To the fullest extent permitted by law, Modern Brand Holdings LLC and its affiliates will not be liable for any indirect, incidental, or consequential damages arising from your use of the Services or products purchased.

These Terms are governed by and construed in accordance with the laws of the State of Texas, USA. You consent to venue and personal jurisdiction in the courts located in Texas.

We reserve the right to update or change these Terms at any time. Material changes will be communicated via email or site notice where required by law. Your continued use of the Services after changes constitutes acceptance. These Terms are effective August 12, 2026.
